In accordance with regulation 5(1) of the Environmental Information Regulations 2004 (EIR), Oxford City Council (OCC) confirms that it holds information falling within the scope of your request.

 

OCC confirms that no pre-application enquiry was made in relation to planning application 26/01398/FUL prior to the submission of the application. It has also confirmed that no pre-application correspondence or advice falling within the scope of your request is held by OCC.

 

OCC is therefore unable to provide the requested correspondence or advice because it does not hold that information.

 

Regulation 12(4)(a) of the EIR applies where a public authority does not hold the requested information when the request is received.

 

Although the exceptions under regulation 12 are generally subject to the public interest test, the Information Commissioner recognises that no meaningful public interest test can be undertaken where the requested information is not held.
