1. Freedom of Information request under the Freedom of Information Act 2000 We would like to request information relating to licenced animal operators in the area for which you are responsible. For each operator with a licence issued under the Animal Welfare (LIAIA) (England) Regulations 2018 would you please provide: * Licence number * Operator name * Type of Licence (Commercial boarding cats, Commercial boarding dogs, Home boarding dogs, Dog day care/Arranger, Dog breeding, Hiring of Horses, Exhibition animals, Selling as pets) * Star rating * Licence expiry date * Number and type of animals * Address Line 1 * Address Line 2 * Address Line 3 * Postcode, Part of Postcode, Ward or town name If possible, please provide this information in electronic format as an excel spreadsheet. 2. The information provided below reflects the records held by OCC for the purposes of responding to your request. The “operator name” column contains the business or operator name recorded by OCC against the relevant licence.

For Temple Cattery and PetStay Oxfordshire, OCC have recorded the relevant status as “pending”. As “pending” is a decision or application status rather than an expiry date, OCC has described these entries as “decision pending” and has not represented that wording as a confirmed licence expiry date.

The activities identified above are regulated under the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018, which provide for the licensing of activities including selling animals as pets and providing or arranging boarding for cats or dogs.

OCC has considered whether any of the disclosed information constitutes personal data for the purposes of the Data Protection Act 2018 (DPA) and the United Kingdom General Data Protection Regulation (UK GDPR). Information relating to an individual operator or to a business operated from a residential address may constitute personal data.

OCC has considered whether any of the information disclosed constitutes personal data under the Data Protection Act 2018 (DPA) and the UK General Data Protection Regulation (UK GDPR). Some information may relate to individuals or businesses operating from residential addresses.

However, the information disclosed relates to the operation of regulated, licensable commercial activities. There is a legitimate public interest in enabling members of the public to identify licensed businesses, understand the activities for which they are licensed and verify the premises connected with those activities.

OCC considers that disclosure of the information set out above is necessary and proportionate for those purposes. The information concerns the operators in their licensed business capacity and does not include unrelated private information.

OCC has therefore concluded that disclosure would not contravene the data protection principles. The exemption under section 40(2) of the FOIA, which concerns the personal data of third parties, has not been applied.

No other exemption under the Freedom of Information Act 2000 has been applied to the information provided in this response.

OCC has treated the second part of your correspondence as a request under the Re-use of Public Sector Information Regulations 2015 (RPSI).

Regulation 6 of the RPSI provides that a request for re-use must be made in writing, state the applicant’s name and address for correspondence, specify the information requested for re-use and identify the purpose for which it is to be re-used. OCC is satisfied that your request meets those requirements.

Regulation 7 of the RPSI provides that, subject to the exclusions and qualifications contained within those Regulations, a public sector body must permit re-use where it receives a valid request.

OCC permits the information disclosed in this response to be republished on the animal-licensing.uk website for the purpose stated in your request. No charge will be made for this re-use.

To the extent that OCC owns any copyright or database rights in the information, re-use is permitted under the terms of the Open Government Licence version 3.0.

The information should be attributed as follows:

“Contains public sector information provided by Oxford City Council and licensed under the Open Government Licence version 3.0.”

The information must not be used in a manner that suggests that OCC endorses Animal Insight Limited, the animal-licensing.uk website or any service, product or conclusion associated with that website.

The information must not be presented in a misleading manner or in a way that misrepresents its source. The date to which the information relates should be made clear so that users are not led to believe that the information necessarily represents the current licensing position at a later date.

The permission granted applies only to intellectual property rights that OCC is authorised to license. It does not extend to OCC logos, crests, branding, trade marks or any intellectual property rights owned by a third party.

The Open Government Licence version 3.0 does not cover personal data. Where any of the disclosed information constitutes personal data, any subsequent publication or other processing of that information must comply independently with the DPA and the UK GDPR.

Animal Insight Limited will therefore be responsible for ensuring that any further use or publication of personal data has an appropriate lawful basis and complies with the applicable data protection principles.

This does not prevent the re-use requested. It clarifies that permission under the RPSI does not remove the separate legal responsibilities that apply to an organisation processing personal data.

If you disagree with any part of the response to your request, you are entitled to ask the Council for an internal review of the decision(s) made.
